DISCLAIMER

You “buyer” expressly understand and agree that: (a) this site and any of the services are provided on an "as is" and "as available" basis and that this site does not make, guarantee, offer, or provide warranties, representations or conditions (as used in this section "warranties") of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement and that any such warranties are hereby expressly disclaimed, and (b) this site specifically makes no warranties that a it or any of its services, including any content, information, products or services obtained from or through the use of this site or any of the services, will be provided on an uninterrupted, timely, secure or error-free basis or that such services or the results derived therefrom will meet your requirements or expectations.

Buyer is responsible to adhere to Insomniac Terms of Use, as well as, 0Ft Away Store Terms of Sale as outlined below:

BILLING INFORMATION VERIFICATION

Orders are processed only after a billing address, and other billing information, has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, Customer Service will attempt to contact you, using the information provided at the time of purchase. If Customer Service is unable to reach you after its initial attempt, Customer Service may cancel your order and may sell your tickets to another customer without further notice.

PRICING AND PAYMENT PLANS

The price you pay for the selected item, is the price at the final stage of the checkout process, payment must be: (1) Paid in full. (2) Approved for payment plan through ZIPPAY and make 1st payment (of 4) at time of purchase. Please review ZIPPAY Terms of Service here. (3) Enroll in an Extended Payment Plan, through PayPal, and make a down payment of $150(min) toward package purchase and a $100 Payment Plan Processing Fee due upon receipt of the initial invoice. *DO NOT USE THE CHECKOUT PAGE. Buyer has up until 30 days prior to the event to complete all payments, including a $100 Processing Fee for the payment plan. You acknowledge and agree that the Processing Fee is fully earned upon payment and is non-refundable, including without limitation if you fail to complete your Extended Payment Plan.

YOU UNDERSTAND THAT YOU MUST MAKE EACH PAYMENT BY THE DUE DATE ON THE INVOICE IN ORDER TO COMPLETE YOUR LAYAWAY PURCHASE AND RECEIVE THE PASSES. IF YOU FAIL TO MAKE ANY PAYMENT BY ITS DUE DATE, YOU UNDERSTAND AND AGREE THAT YOUR LAYAWAY PLAN WILL AUTOMATICALLY TERMINATE, YOU WILL NOT RECEIVE THE PASSES, AND THE PASSES MAY BE SOLD TO OTHERS. YOU FURTHER UNDERSTAND THAT YOU WILL RECEIVE A REFUND OF ANY PAYMENTS YOU HAVE MADE PRIOR TO THE TERMINATION DATE (EXCLUDING THE PROCESSING FEE) LESS AN AMOUNT EQUAL TO $100.00 USD.

REFUND, EXCHANGE, OR RE-SALE OF TICKETS

All purchases are non-refundable and not able to be exchanged. If you can no longer attend the event, or complete your payment plan, you are responsible for finding a new buyer for your ticket. There are plenty of resources to help in these instances:

LODGING

You are responsible to provide a valid ID and check-in to the hotel on/after the date/time listed on your itinerary. No one else, other than those names listed on the order, can check-in for the room. Late arrivals/early departures will not be refunded to the buyer, unless prior arrangements have been made. The buyer's name will be listed on the reservation for the room and thus are responsible for your room, guests, and any damages during your stay. Hotel’s may require a credit card, for incidentals, to be put on file at time of check-in. *RESORT FEES ARE NOT COVERED AS PART ANY PACKAGES. BUYER WILL BE RESPONSIBLE FOR SAID FEES AT TIME OF CHECK-IN. (This is set by the hotel/resort and we cannot pay these fees in advance)

TRANSPORTATION

Buyers will be provided an Uber credit, in the weeks leading up to the event via email, to the registered email address on the order in order to cover transportation costs to/from the airport. This amount varies based on location and current rates at the time of ticket listing. If your roundtrip costs for transportation exceed 50% of the amount that was provided in your package, you may contact us to get reimbursed. *We will only honor the lowest economy class for your ride. If you wish to book an upgraded ride (ie: Uber XL, Uber Black, Lux, Lux Black, etc..), you will be responsible for the difference.

To submit a reimbursement request, please have the following ready:

  • Order Number

  • Ride receipts, for each ride. (to include screenshot of trip route) 2max

Shuttles: If shuttle passes are included with your package, be aware of the pickup times/location listed on your itinerary. Once shuttle passes are received by the purchaser, all responsibility regarding said passes falls expressly on them.  0Ft Away and/or its affiliates can and will no longer be responsible following the successful purchaser pick up of shuttle passes.  If the purchaser is in need of further assistance, it is recommended that they contact Insomniac and EDCLV customer or on-site support.

TEMPTATION SUNDAYS POOL PARTY

This event is an independently curated and hosted event outside the scope of 0Ft Away or its team and affiliates.  As such, ticketing availability will be limited.  As of the time of these guidelines being published, there have been no official announcements made regarding the timing, ticketing, or packaging that may be available to purchasers.  This information will be shared as it becomes available and may be added to your package as an add on at the time of purchase.  Package add on and Payment Plans may be available depending on availability.   All regulations found within this document, in addition to event specific regulations, will apply.  For more information regarding this event, please click here.   

CANCELED/POSTPONED EVENTS

Occasionally, events are canceled or postponed by the promoter, team, band or venue. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any canceled or postponed event, please check the event information online or contact us. If a refund is issued, please allow time for the Promoter to issue the refund, and we will issue your refund as prompt as possible.

Customer Service typically only offers refunds and/or exchanges based on the promoter's, team's or venue's instructions. Customer Service is not obligated to issue a refund except to the extent that the promoter, team or venue responsible for bringing you the event (1) instructs us to issue a refund, and (2) provides us with the ticket funds necessary to issue refunds. In order to receive a refund or an exchange that may be offered, you will have to comply with the promoter's, team's or venue's instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the promoter's, team's or venue's discretion.

LIMITATION OF LIABILITY

You expressly understand and agree that in no event shall this site, including its affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether this site had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with: (a) the use, inability to use or performance of any of the services of this site, or (b) any unauthorized access to or modification to any of your content or transmissions, or (c) any other matter relating to this site or any of the services.
